Terms and Conditions

By purchasing any product, service or participating in any program from Growth Mode Technologies LLC it’s subsidiary,  Venturetechnica LLC and/or any of it’s brands including but not limited to Beyond Telephone, Local IT Dept, The Merch Link, 315Live.fm, (“Growth Mode Technologies “) you agree to the following terms and conditions:

Data loss, hacking, viruses, defamation
Growth Mode Technologies is not responsible for damages or expenses related to data loss of any kind.

Payment and Refunds
Acceptable payment methods include all major credit cards or cash. All sales are final. No refunds will be given for any service. Any physical parts or equipment sold are subject to their original manufacturer warranty where applicable.

Late Fees
Late fees will be added to any invoice more than 10 days past due unless otherwise detailed in a signed agreement or public advertisement.

Discounts
Any discounts offered apply only to our services and have no cash value. Discounts expire on any invoice more than 45 days past due unless otherwise noted.

Time Estimates
All mentions of time including project timelines, turn around time, response time or other statement that is provided in written or verbal form is only an estimate. While we will do our best and typically meet every deadline we do not guarantee it.

3rd Party Fees and Expenses
Unless specifically stated otherwise; Growth Mode Technologies is not responsible for any 3rd party fees or expenses that may be required or are incurred for your project or service. This includes but is not limited to: credit card processing, hosting, security certificates, licensing, parts, equipment, 3rd party labor costs or other services.

Holidays
Special rates and service limitations are in effect during holidays. See service descriptions or contact us for details.

The following are considered holidays for all business conducted by Growth Mode Technologies:
– All U.S. Federal (Postal) Holidays
– Flag Day
– Day after Thanksgiving
– December 24th
– December 31st
– St. Patrick’s Day

Grammatical or other text errors
In most situations content is submitted to the customer for approval before going live on the internet. It is the customer’s duty to review any and all text, images, pricing or other details on the website, social media or other location on a regular basis. Growth Mode Technologies is not responsible for any errors or misrepresentations.

Privacy
We do not and will not ever sell anyone’s contact information or personal details. This includes but is not limited to: name, business name, address, credit card information, email address, phone numbers. Any information provided to law enforcement regarding a client requires a legally executed warrant. We will not advertise any business relationship or use any work we have done for a client in any sort of portfolio or other example of our work without the client’s permission.

Links and Blogs
Growth Mode Technologies has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Growth Mode Technologies of the site. Use of any such linked web site is at the user’s own risk. Any and all “blogs”, “podcasts”, “videos”, “news” or other content are provided as basic points of interest. Growth Mode Technologies is not responsible for the accuracy of any content provided.

Broadcast, Video, Audio, Podcast, Etc.

Growth Mode Technologies is not responsible for the comments or actions of the guests, hosts or any other party during a live broadcast or recorded event.

In many cases media content is uncensored. For this reason audience discretion is advised.

Best Effort Services 

All data, hosting, communications, telecom, cloud or other internet connected system or service is provided on a best-effort basis.  100% uptime is not guaranteed unless otherwise noted.

Communications Systems and Services

All equipment is pre-configured and tested in our test environment before it’s shipped out to the customer. In most cases customers can plug in the system at their location and go. Sometimes additional configuration is required depending on the situation and specialized features requested.

Growth Mode Technologies will provide detailed, easy to follow instructions on how to set up the device in a typical environment.

Required components which may not be included:

Internet connectivity  –  You need connectivity to the internet in your main and any satellite locations. If you need options for internet service providers please let us know.

Network switchYou need a network switch to connect the phones to. Most businesses already have network switches in place for their computers. Typically those will work just fine. We recommend a full Gigabit speed switch with QoS where possible. Power over Ethernet (PoE) optional.

Network wiring / outlets – Each phone needs to connect to a standard Cat5/6 RJ45 network connection. A 3ft cable to connect each phone to each outlet is included.

Firewall Configuration (usually optional) – If you wish to access your system from outside your main location you’ll need to configure your firewall to allow incoming access to the phone server.

Operation and Limitations of the 911 Service

Growth Mode Technologies may provide access to emergency calling services, allowing most Growth Mode Technologies users to access either basic 911 or Enhanced 911 (E911) service. Growth Mode Technologies (Beyond Telephone) users, using IP Desk Phones or Softphones, can dial 911 directly from their IP Desk Phones or Softphone. MOBILE USERS COMPLETE 911 CALLS. They should make those calls directly from their cell phone’s regular phone calling app.

We strongly recommend NOT using Beyond Telephone/Growth Mode Technologies or any other VOIP powered phone service for 911 calls. In an emergency we recommend using a cell phone to dial 911 from the native phone app on device. 

Emergency calling services work differently than you may have experienced using traditional wireline or wireless telephones. Your access may differ depending on your location or the device you are using.

Registering Your 911 Location
You must register the address of the physical location where you will use 911 with Growth Mode Technologies immediately upon activation of your End Point. This is your Registered Address. You must use Growth Mode Technologies voice services only at the Registered Address provided for the applicable phone number. If you move a registered device, you must immediately update the Registered Address with the new physical location of the device with Growth Mode. If you do not update the Registered Address, any 911 calls made from the device may be sent to the wrong emergency response center and will not transmit your current location information to emergency responders, delaying emergency assistance to you. It may take up to several hours for the address update to take effect. Customers with more than one Phone Number are solely responsible for ensuring that an accurate and up-to-date Registered Address is maintained for each Phone Number, and that their End Users are aware of how the Registered Address can be changed.

911 Service limitations
Growth Mode Technologies 911 service will not function (i) in the event of an Internet or power outage; (ii) if your broadband, ISP, or Growth Mode Technologies Service is terminated; (iii), with respect to only the Growth Mode Technologies Provided Mobile Applications, if you do not have mobile service, as the Growth Mode Technologies provided Mobile Applications cannot send emergency calls over Wi-Fi access; and (iv) in some Global Office countries. It is possible that network congestion may delay or prevent completion of any 911 call. You will not be able to complete a 911 call if you move to a physical location outside the country in which your Phone Number is provided, or if you are dialing from a Growth Mode Technologies number that is not a Canadian or United States number.

Users uncomfortable with any of these limitations should use an alternate means of reaching 911.

Notification of Employees, Guests, or Other Users
Customers must notify any employees, contractors, guests, or persons who may place calls using the Services or may be present at the physical location where the Services may be used, of the limitations of 911 Service from your IP phone, other equipment, or Softphone. Customer should affix a sticker warning that 911 services may be limited or unavailable in a readily visible place on each piece of equipment that might be used to access or use the Services, as required by 47 C.F.R. § 9.5.

Disclaimer of Liability for Emergency Call Response
Your use, and use by your employees, guests and other third parties, of Growth Mode Technologies’s 911 Services are subject to the limitations described herein. The availability of certain features, such as transmission of a Registered Address or your Growth Mode Technologies telephone number, depends on whether local emergency response centers support those features, and other factors outside of Growth Mode Technologies’s control. Growth Mode Technologies relies on qualified third parties to assist us in routing 911 calls and text messages to local emergency response centers and to the NECC. Growth Mode Technologies does not have control over local emergency response centers, the NECC, emergency responders, or other third parties. Growth Mode Technologies disclaims all responsibility for the conduct of local emergency response centers, the NECC, third parties engaged by Customer to facilitate address updates, and all other third parties involved in the provision of emergency response services. To the extent permitted by applicable Law, you hereby release, discharge, and hold harmless Growth Mode Technologies from and against any and all liability relating to or arising from any acts or omissions of such third parties or other third parties involved in the handling of or response to any emergency or 911 call.

Customer indemnifies and holds harmless Growth Mode Technologies, and any third-party provider(s) from any and all third-party claims, losses, damages, fines, or penalties arising out of: (i) Customer or its End User’s provision to Growth Mode Technologies of incorrect information, including physical addresses, or failure to update a Registered Address; (ii) Customer’s failure to properly notify any person who may place calls using the Services of the 911 limitations; or (iii) the absence, failure, or outage of emergency service dialing using the Services for any reason; and (iv) the inability of any End User to be able to dial 911 or access emergency service personnel for any reason.
